Apple demands to know how FBI cracked San Bernardino iPhone

The FBI recently dropped its case against Apple after a third-party was able to break into the iPhone used by Syed Farook. Now, Apple is demanding to know how they did it.

In the Apple vs FBI controversy, the roles have officially been reversed.

On Monday, the Justice Department dropped its case against Apple after it was able to unlock the iPhone used by San Bernardino shooter, Syed Farook, with the help of an "outside party." Now, Apple wants to know just how they did it.

The controversy around the phone began when Apple refused a court order to unlock the phone for the FBI to assist with their investigation. Apple would have been required to rewrite its OS with fewer security measures in place so that it could be accessed by the authorities.

However, a filing posted by the FBI on Monday stated: "The government has now successfully accessed the data stored on Farooks iPhone and therefore no longer requires the assistance from Apple Inc. mandated by Courts Order Compelling Apple Inc. to Assist Agents in Search dated February 16, 2016."

"Its the best and worst case scenario for [Apple]," said John Pironti, of IP Architects. "The best case scenario is that they can continue to say that theyre doing everything they can do, and that they did not support law enforcement in this way."

Apple didnt have to create any custom code to help the authorities, nor did it have to violate its own ethical standards. But, the fact that the FBI and its unknown partner were able to unlock the phone means that there is a security flaw that Apple may be unaware of.

The FBI has yet to disclose who helped them crack the iPhones security, or what measure was used to accomplish the task. And, if the potential vulnerability goes unchecked, it could be leveraged by malicious hackers to steal information from other iPhones.

So far, most people can only guess how the phone was unlocked. Some reports have indicated that Israeli company, Cellebrite, may be the unknown party that assisted the FBI. Others have speculated that the limit on incorrect password guesses was lifted, allowing the FBI to run software that eventually guessed the correct passcode. Another method, Pironti said, would be through using copied images on an emulator.

"You would take an image of the actual device, recreate the image into an emulator and then, using the emulator, you would run permutations against emulated devices," Pironti said.

The core device would still be safe and you would just keep making copies and running number combinations on those copiesÑalmost like a virtual machine. At the time of this writing, though, nothing has been confirmed.

So now, Apple needs the FBIs help. Or, at least, its sympathy. Although, that it may be difficult for Apple to convince the FBI of its plight, as it continually pushed back against the FBIs ordersÑgoing as far as to increase the encryption on their devices in light of the FBIs original case.

This brings a new question, will the FBI ever help Apple out? If we are simply counting an eye for an eye, there is no reason for the FBI to explain its tactics. But, there are also more strategic reasons for refusing Apples request.

ZDNets Zack Whittaker recently pointed out a tweet by the ACLUs Christopher Soghoian that read: "The [government] doesnt disclose security flaws to firms like Apple if useful to law enforcement."

It makes sense that the FBI would like to keep its method under wraps. For one, if they disclose the method (and subsequently, the flaw it exploits) Apple will remedy the issue, and the FBI will no longer have a way into future iPhones. And, as some have pointed out, the FBIs current contention with Apple involve about 15 other iOS devices that they want access to. So, if they found a way in, why would they give it up?

Also, the U.S. government has a history of keeping these kinds of capabilities hidden.

"The Snowden releases released ways that the NSA had been able to compromise iPhones for years, and that was never disclosed to Apple, at least that I know of, until the Snowden releases," Pironti said.

Apple took direct action immediately after the Snowden releases to improve the iPhones security, and their stance has continued to focus heavily on encryption.

The LA Times reported that Apples attorneys are researching ways that they could legally compel the FBI to reveal the method used to hack the phone, but no updates have been released. Benjamin Wright, an attorney and instructor at the SANS Institute, isnt convinced that Apple would have much of a case if they did pursue a legal avenue.

"It just feels like quite a stretch for Apple to use some mechanism of law to force the police to reveal what they did, when Apple wasnt involved," Wright said.

At the time of the investigation, the phone was owned by the county of San Bernardino, and the county gave permission to the FBI to do whatever they needed to do in order to gather evidence. There could be some language in the end-user license agreement regarding IP or reverse engineering, that could potentially be used in a legal case, but Wright said that would likely be a stretch as well. Theres also another option, Wright said.

"To get information about how the FBI cracked the iPhone, Apple might allege that the third party who did the work violated an Apple patent or stole a trade secret from Apple," Wright said. "A substantiated allegation like that might justify a lawsuit by Apple against the third party. Such a lawsuit might justify legal discovery of the technique used by the third party."

Jay Edelson of Edelson PC, which does privacy class action work in the tech sector, said that the legal situation shouldnt be taken lightly by either party.

We do not believe the government has a legal duty to tell Apple the details about the backdoor it found. However, we believe it is in the nations security interests that the government start working with the private sector to identify and close cyber vulnerabilities. Right now, the government has inconsistent interests. On the one hand, it doesnt want to see companies get hacked, and knows that cyber terrorism is aimed at private companies, along with the government. On the other hand, it does not tolerate the idea that systems are totally secure because it always wants to maintain the option of gaining access for law enforcement, anti-terrorism, or other purposes. We believe the government cannot straddle the fence on this issueÑit should be helping companies prevent hacks, even if it means that increased security will make their job harder in certain instances.

Additionally, Wright said, the timing for the news about the iPhone being unlocked was a little suspicious. Wright said he felt the FBIs original legal case was weak, and its agenda wasnt so much to procure specific data from one phone, but to set precedent for law enforcement to force Apple to cooperate. However, the FBI didnt realize how weak its case was until Apple pushed back as hard as it did.

"The FBI realized it was about to get a judge ruling against the FBI, and they didnt want that precedent so, magically, they produced some other third party whos come out of nowhere to save the day," Wright said.

Apple Unveils Smaller Screened iPhone SE to Jump Start Sales

Apple Inc. unveiled a new, smaller iPhone that will start at $399, seeking to jump-start sales of its flagship product by enticing more users to upgrade, especially in high-growth markets such as China and India.

The iPhone SE has a 4-inch-screen, comes in four stainless-steel finishes, and incorporates the faster A9 processor that also runs the larger iPhone 6S handsets, Apple Vice President Greg Joswiak said at an event Monday at the companyÕs Cupertino, California, headquarters. Apple also showed off a new iPad, incorporating the power and some features of its larger Pro model for business users, and cut the price of its year-old Apple Watch.

The revamped compact iPhone arrives two months after Apple said quarterly sales will probably decline for the first time since 2003, heightening concern that demand for high-end smartphones has reached its peak. CustomersÕ eagerness to freshen their handsets regularly has waned in the past two years, and the updated model could encourage those holdouts to buy a new iPhone. The company said it sold 30 million of the older 4-inch iPhones last year, including the majority of its Chinese sales -- a market where it risks losing share without an updated lower-end option.

ÒThe iPhone SE will improve traction in emerging markets,Ó said Bill Kreher, a St. Louis-based senior technology analyst at Edward Jones & Co. ÒApple needs to better position itself against the plethora of Android-based devices that are available at low price points, and we think they effectively accomplished that here."

FBI Standoff

Earlier, Chief Executive Officer Tim Cook opened the event by wading into the political debate over privacy and encryption. Cook was first to take the stage, and immediately addressed AppleÕs legal standoff with the FBI over a court order requiring the company to help the U.S. unlock the handset of a terrorist who killed 14 people in San Bernardino last year. Cook said heÕs humbled by the support Apple has received from Americans.

ÒWe did not expect to be in this position, at odds with our own government, but we believe strongly we have a responsibility to help you protect your data and your privacy,Ó he said. ÒWe will not shrink from this responsibility.Ó

In a series of filings over the past month, Apple has repeatedly sought to frame the FBI debate as a potential threat to the privacy of hundreds of millions of iPhone users around the world. For its part, the U.S. Justice Department wants to keep the discussion focused on the individual handset that is the subject of the case.

A hearing scheduled Tuesday before a judge in Riverside, California, was canceled after the Justice Department said in a court filing Monday that it may have learned of a way to break into the locked iPhone without the companyÕs help. The judge ordered the government to file a report on the status of its efforts by April 5.

ÒWe need to decide as a nation how much power the government should have over our data and over our privacy,Ó Cook said earlier. As he exited the stage at the close of the event, the companyÕs music choice seemed to underscore his message: speakers played a version of Tom PettyÕs song ÒI WonÕt Back Down.Ó

SE Features

The iPhone SE comes with 16 or 64 gigabytes of storage, with the latter model costing $499. IPhone SE has full support for the Siri voice-enabled digital assistant, a 12-megapixel camera, and includes features found on the larger phones like Apple Pay and the more secure Touch ID fingerprint scanner.

With the SEÕs pricing, Apple is Ògetting serious about gaining more share in the mid-priced smartphone market vs. competitors like Samsung, Huawei, Oppo and LG, as the growth in the premium priced segment is slowing,Ó said New York-based Bloomberg Intelligence analyst John Butler. ÒA move to broaden its presence in the mid-priced segment represents AppleÕs bid to sustain growth.Ó

While analysts from UBS Group AG to RBC Capital Markets predict about 15 million annual shipments of AppleÕs new handset, introducing the product in the spring may help bolster revenue over the summer, when sales traditionally dip. Apple sold 231 million iPhones in the last fiscal year.

"From a value proposition standpoint, we think itÕll find its niche," Edward JonesÕs Kreher said. "At the same time, itÕs important to know that AppleÕs iPhone 7 update in September will be more critical."

Orders for the new smartphone and iPad begin Thursday, and both will be shipped starting March 31. The company also showed new band styles for Apple Watch, made of woven nylon. Prices for that device will now start at $299, down from $349.

Before the hardware announcements, executives came on stage to emphasize AppleÕs corporate responsibility efforts. Lisa Jackson, head of AppleÕs environment, policy and social initiatives, unveiled a robot dubbed Liam that disassembles used iPhones in order to recycle components, while Chief Operating Officer Jeff Williams highlighted a new health monitoring and tracking app called CareKit. The tool builds on the existing HealthKit research app.

Smaller Pro

Phil Schiller, AppleÕs senior vice president and head of marketing, led the unveiling of the iPad Pro with a 9.7-inch display, a smaller version of the 12.9-inch Pro tablet designed for business users that was first introduced in September. The new Pro will start at $599 for a 32-gigabyte model.

Apple chose to introduce a new 9.7-inch model because Òit has remained our most popular size,Ó Schiller said.

Revenue from AppleÕs tablet, introduced in 2010, fell by 21 percent in the three months that ended in December, with existing users seeing no need to buy updated models and more people choosing larger phones instead. The company sold 16.1 million of the devices in the quarter, a 25 percent decline from the holiday quarter a year earlier.

Tablet shipments are forecast to decline 5.9 percent to 195 million units in 2016, according to market researcher IDC. Apple is projected to win 22 percent of the worldwide market in 2020, a decline from 29 percent this year, according to an IDC report earlier this month. Still, Schiller underscored that AppleÕs goal with the iPad is winning over users whose PCs are becoming outdated, especially as the handheld devices add more of the larger machinesÕ functionality.

ÒThere are over 600 million PCs in use today that are over five years old,Ó Schiller said. ÒThis is really sad.Ó
